North Dakota Says It Has Right To Intervene In Case Against EPA About Waste Rule

(August 31, 2017, 2:36 PM EDT) -- WASHINGTON, D.C. — The state of North Dakota on Aug. 18 filed a reply brief in the District of Columbia Circuit U.S. Court of Appeals, arguing that it should be granted leave to intervene in a case brought against the U.S. Environmental Protection Agency by environmental groups that argue that the agency has failed to meet the nondiscretionary duty under the Resource Conservation and Recovery Act (RCRA) to review and, if necessary, revise regulations for wastes associated with the exploration, development or production of crude oil, natural gas or geothermal energy (Environmental Integrity Project, et al. v.
