3rd Circuit Rules That FTC’s Cybersecurity Case Against Wyndham May Proceed

Mealey's (August 24, 2015, 2:09 PM EDT) -- PHILADELPHIA — Wyndham Worldwide Corp. was on notice that the Federal Trade Commission “has authority to regulate cybersecurity under the unfairness prong of” the Federal Trade Commission Act (FTC Act), a Third Circuit U.S. Court of Appeals panel ruled Aug. 24, affirming a trial court’s denial of Wyndham’s motion to dismiss claims against it related to three breaches of the hotel chain’s networks (Federal Trade Commission v. Wyndham Worldwide Corp., et al., No. 14-3514, 3rd Cir.).
