Georgia Appeals Court: Arbitration Agreement Signed By Daughter Unenforceable
Mealey's (July 14, 2017, 6:15 PM EDT) -- ATLANTA — A Georgia appeals panel on June 22 held that a nursing home arbitration agreement signed by a resident’s daughter was unenforceable because the resident did not personally assent to the arbitration agreement and the daughter did not have express or implied authority to sign the agreement on the woman’s behalf (United Health Services of Georgia, Inc., et al. v. Alexander, et al., No. A17A0335, Ga. App., 5th Div., 2017 Ga. App. LEXIS 302).
