California Appellate Court: No Class Certification In L’Oreal Song-Beverly Suit

(August 20, 2015, 3:22 PM EDT) -- LOS ANGELES — Individual issues surrounding the question of liability predominate, preventing class certification in a complaint accusing L’Oreal USA S/D Inc. of violating the Song-Beverly Credit Card Act of 1971 when its Kiehl’s Since 1851 store employees request personal identification information (PII) from customers in connection with credit card transactions, a Second District California Court of Appeal panel ruled July 20 (Allen Adjamian v. L’Oreal USA S/D, Inc., No. B257403, Calif. App., 2nd Dist., Div. 3; 2015 Cal. App. Unpub. LEXIS 5072).
