Remand To State Court Denied In Suit Over Yogurt Marketing

Mealey's (August 20, 2015, 7:47 AM EDT) -- SAN DIEGO — The lead plaintiff’s stipulation in a class suit over the marketing of Chobani LLC yogurt that the amount is controversy is less than the Class Action Fairness Act’s (CAFA) $5 million threshold is insufficient to send the case back to state court, a California federal judge ruled Aug. 10 (Chayla M. Clay, et al. v. Chobani LLC, et al., No. 14-2258, S.D. Calif.; 2015 U.S. Dist. LEXIS 105433).
