Judge Dismisses ACA Individual Mandate Tax Refund Case On Jurisdictional Grounds

Mealey's (August 19, 2015, 2:39 PM EDT) -- DETROIT — Absent evidence that a man completely satisfied his full amount due under the Patient Protection and Affordable Care Act (ACA) shared responsibility payment (SRP), a court lacks jurisdiction over his refund suit, a federal judge in Michigan held Aug. 17 (Scott Lipiec v. United States of America, et al., No. 15-10402, E.D. Mich.; 2015 U.S. Dist. LEXIS 107593).
