Judge Finds Pre-ACA Disclosure Standard Doesn’t Bar False Claims Act Case
(August 18, 2015, 12:16 PM EDT) -- PIKEVILLE, Ky. — The bar on actions based on publically disclosed information in place before passage of the Patient Protection and Affordable Care Act (ACA) doesn’t bar a False Claims Act (FCA) action based on direct knowledge of the alleged conduct, a federal judge in Kentucky held July 27 (United States of America, et al. v. Eric C. Conn, et al., No. 11-157, E.D. Ky.; 2015 U.S. Dist. LEXIS 97433).
