Medical Damages Award Offset By Potential ACA Recoveries, Judge Says

Mealey's (August 18, 2015, 9:26 AM EDT) -- LOS ANGELES — A federal judge on Aug. 13 applied existing recoveries of medical costs and reduced a man’s award for the accidental injection of a chemotherapy drug into his eye to $1,501,430.36. The judge on July 24 found that the even potential Patient Protection and Affordable Care Act (ACA) insurance coverage constituted a collateral source of insurance under California law (Stephan Brewington v. United States of America, No. 13-7672, C.D. Calif.; 2015 U.S. Dist. LEXIS 97720).
