Xarelto MDL Judge Denies Summary Judgment In 1st 2 Bellwether Trials

Mealey's (April 27, 2017, 4:28 PM EDT) -- NEW ORLEANS — The Louisiana federal judge overseeing the Xarelto multidistrict litigation on April 17 denied partial summary judgment in the first upcoming bellwether trials, saying Louisiana’s learned intermediary doctrine does not bar the plaintiffs’ claims that the defendants could have instructed prescribing physicians about the use of blood-clotting tests to avoid bleeding injuries caused by the anticoagulant drug (In Re:  Xarelto [Rivaroxaban] Products Liability Litigation, MDL Docket No. 14-md-2592, E.D.
