Federal Circuit Partly Affirms, Vacates In Surgical Device Patent Case

(August 10, 2015, 11:00 AM EDT) -- WASHINGTON, D.C. — Although an Ohio federal judge erroneously invalidated two surgical device patents and improperly resolved issues of material fact in favor of a moving party, he did not err in finding that the same defendants did not infringe several related design patents, the Federal Circuit U.S. Court of Appeals ruled Aug. 7 (Ethicon Endo-Surgery Inc. et al. v. Covidien Inc., et al., No. 14-1370, Fed. Cir.; 2015 U.S. App. LEXIS 13798).
