Delaware Federal Judge: Massachusetts, Not New York, Best Forum for Patent Case

Mealey's (August 7, 2015, 1:23 PM EDT) -- WILMINGTON, Del. — Citing the “unusual circumstances” surrounding a dispute over an improved active pharmaceutical ingredient (API) for oxycodone hydrochloride, as well as an abuse deterrent feature for addictive drugs, a Delaware federal judge on Aug. 6 agreed to transfer the case to Massachusetts — as requested by several patent infringement plaintiffs — and not New York, as requested by defendant Collegium Pharmaceutical Inc.
