Medical Evidence Supports Claim For Long-Term Benefits, 6th Circuit Panel Says

Mealey's (August 7, 2015, 8:39 AM EDT) -- CINCINNATI — Because substantial and objective medical evidence supports a claimant’s disability, a plan administrator acted arbitrarily and capriciously in denying a claim for long-term disability (LTD) benefits, the Sixth Circuit U.S. Court of Appeals said July 29 in reversing a judgment entered against the claimant (Raymond Shaw v. AT&T Umbrella Benefit Plan No. 1, No. 14-2224, 6th Cir.; 2015 U.S. App. LEXIS 13194).
