Judge Finds Allegations Of Transgender Discrimination Can’t Support ACA Claim

Mealey's (August 6, 2015, 11:48 AM EDT) -- NEW YORK — Three transgender individuals cannot show that New York law violates the Patient Protection and Affordable Care Act (ACA)’s ban on sex discrimination absent some evidence that treatments barred to young transgender individuals are available to others, a federal judge in that state held July 29 (Angie Cruz, I.H., Ar’es Kpaka and Rita Christie, et al. v. Howard Zucker, as Commissioner of the Department of Health [of the State of New York], No. 14-4456, S.D. N.Y.; 2015 U.S. Dist. LEXIS 99323).
