Judge Dismisses Fracking Fluid Injection Case For Use Of ‘Inflammatory Rhetoric’

(January 23, 2017, 2:11 PM EST) -- FRESNO, Calif. — A federal judge in California on Jan. 20 granted a motion to dismiss a lawsuit against oil and gas companies brought by an environmental group and two residents, saying the court is “concerned regarding the unnecessary and inflammatory rhetoric employed in the allegations” of the plaintiffs’ first amended complaint, which alleged that the companies engaged in a conspiracy “to achieve through illegal means the goal of increasing oil production and maximizing profits and tax revenue” by allowing the oil companies to inject saltwater into fresh water in violation of the Safe Drinking Water Act (SDWA) (Committee to Protect Our Agriculture Water v. Occidental Oil & Gas Corporation, et al., No. 15-1323, E.D. Calif.)....
