North Dakota Says EPA Lacks Authority To Regulate Methane Emissions From Fracking

(November 16, 2016, 2:17 PM EST) -- WASHINGTON, D.C. — The state of North Dakota on Nov. 14 filed a brief in the District of Columbia Circuit U.S. Court of Appeals arguing that its case challenging the Environmental Protection Agency’s final rule for emission standards for new, reconstructed and modified sources in the oil and natural gas sector should be bifurcated to first litigate whether the agency has the authority to regulate the amount of methane emitted during hydraulic fracturing operations (North Dakota v.
