Split 8th Circuit Reinstates Respiratory Therapist’s Disability Bias Suit

Mealey's (November 10, 2016, 7:17 AM EST) -- ST. PAUL, Minn. — A respiratory therapist who was fired after temporary physical restrictions prevented her from having an up-to-date basic life support certification provided evidence that she could have performed the essential functions of her job, a divided Eighth Circuit U.S. Court of Appeals panel ruled Oct. 17, reversing a summary judgment ruling in favor of the therapist’s former employer (Roberta Kowitz v. Trinity Health, et al., No. 15-1584, 8th Cir.; 2016 U.S. App. LEXIS 18559).
