Illinois Court Affirms Instructions, But Orders New Trial On Damages

(November 7, 2016, 1:11 PM EST) -- SPRINGFIELD, Ill. — A jury’s pecuniary damages award in an asbestos case includes compensation for parties for whom there is no evidence of pecuniary loss, an Illinois appeals court held Oct. 18 in ordering a new trial on the issue while otherwise affirming the verdict (Estate of Paul McGowan v. Central Illinois Railroad Co., No. 08L177, Ill. App., 4th Dist. 2016 Ill. App. Unpub. LEXIS 2217).
