Insurer Argues That Res Judicata Bars Plaintiffs From Collecting Damages

Mealey's (October 24, 2016, 11:34 AM EDT) -- INDIANAPOLIS — An insurer filed a motion for summary judgment on Oct. 14 in an Indiana federal court, arguing that it has no duty to defend its insured against claims arising out of environmental contamination because the plaintiffs’ claims are barred by res judicata (Carmine Greene, et al. v. Kenneth Will, et al., No. 09-510, N.D. Ind.).
