Judge Remands Case, Says Agency Acted ‘Arbitrarily’ When It Approved Fracking

Mealey's (October 7, 2016, 3:11 PM EDT) -- SALT LAKE CITY — A federal magistrate judge in Utah on Oct. 3 ruled that the U.S. Bureau of Land Management (BLM) acted “arbitrarily and capriciously” when it found that there was no significant impact related to natural gas drilling, exploration and development as a result of hydraulic fracturing in the Uinta Basin of Utah (Southern Utah Wilderness Alliance, et al. v. United States Department of the Interior, et al. and Gasco Energy Inc., No. 13-01060, D. Utah).
