North Carolina Federal Judge Refuses To Dismiss ERISA Claims Against Aetna
(September 13, 2016, 10:01 AM EDT) -- ASHEVILLE, N.C. — A North Carolina federal judge on Aug. 31 denied defendants’ motion to dismiss two claims for breach of fiduciary duty brought under the Employee Retirement Income Security Act because the plaintiff sufficiently alleged an injury in fact (Sandra M. Peters, et al. v. Aetna Inc., et al., No. 1:15-cv-00109, W.D. N.C.; 2016 U.S. Dist. LEXIS 117326).
