Judge Denies Class Status To Residents In Fracking Royalty Dispute
(September 6, 2016, 12:54 PM EDT) -- ALBUQUERQUE, N.M. — A federal judge in New Mexico on Aug. 16 denied class certification to a group of landowners and leaseholders who had sued a group of hydraulic fracturing companies alleging that the companies had underpaid royalties. The judge held that the proposed class was “not ascertainable” (Steven J. Abraham, et al. v. WPX Production Productions LLC, et al., No. 12-0917, D. N.M.; 2016 U.S. Dist. LEXIS 108492).
