9th Circuit Grants Habeas Relief; Judge Criticizes Tribe's Justice System

Mealey's (September 1, 2016, 12:17 PM EDT) -- SAN FRANCISCO — On a panel rehearing, the Ninth Circuit U.S. Court of Appeals on Aug. 30 reversed itself and directed a federal court to grant a writ of habeas corpus to a Native American convicted of domestic assault, in a decision in which the authoring judge wrote a separate concurrence to lash out at an Indian tribe’s “dubious” criminal justice system and its “rat’s nest of problems” (Fortino Alvarez v.
