6th Circuit Panel Affirms Dismissal Of Insurer’s Claim Against ERISA Plan

Mealey's (July 27, 2016, 9:43 AM EDT) -- CINCINNATI — A Sixth Circuit U.S. Court of Appeals panel on July 21 affirmed dismissal of a no-fault automobile insurer’s claim for reimbursement of an insured’s medical services bills from an Employee Retirement Income Security Act plan administered by Blue Cross Blue Shield of Michigan (BCBSM) because it has no standing to bring a claim under federal common law or ERISA (Farm Bureau General Insurance Company of Michigan, v. Blue Cross Blue Shield of Michigan, No. 15-2323, 6th Cir.; 2016 U.S. App. LEXIS 13453).
