Judge: Post-ACA Lifetime Retiree Benefits Cap Survives Challenge
Mealey's (June 24, 2015, 1:58 PM EDT) -- LOS ANGELES — The administrator of a retiree health care plan reasonably concluded that the plan’s lifetime cap on benefits survives the Patient Protection and Affordable Care Act (ACA)’s bar on such limits, a federal judge held May 13. The plaintiff appealed the ruling on June 9 (Gary King v. Blue Cross and Blue Shield of Illinois, et al., No. 13-1254, S.D. Calif.; 2015 U.S. Dist. LEXIS 66963).
