6th Circuit Panel: Court Gave Proper Jury Instructions In Mine Accident Suit

(July 12, 2016, 12:00 PM EDT) -- CINCINNATI — The Sixth Circuit U.S. Court of Appeals on June 30 affirmed a federal judge’s decision to instruct jurors that a company that made a conveyer-car used in a mining system used in a mine could be found liable for negligent failure to warn only if a man fixing the system in the mine was unaware of the danger of the car rolling back on him (Anthony Smith Jr., et al. v.
