Judge: Local Ordinance Banning UIC Fracking Wells Is Preempted By State Law
(July 11, 2016, 10:49 AM EDT) -- CHARLESTON, W.Va. — A federal judge in West Virginia on June 10 ruled that a local ordinance banning the disposal of hydraulic fracturing wastewater in underground injection control (UIC) wells and regulating the storage of wastewater at conventional drilling sites is preempted by state law (EQT Production Company v. Matthew D. Wender, No. 16-00290, S.D. W.Va.; 2016 U.S. Dist. LEXIS 75685).
