New York State Justice Dismisses Tribe’s Suit Over Unlicensed Smoke Shop

Mealey's (June 24, 2015, 10:05 AM EDT) -- RIVERHEAD, N.Y. — A New York state justice on May 28 denied a motion by the Unkechaug Indian Nation for injunctive relief against the Smokes for Less Smoke Shop in the tribe’s case accusing the owner of the smoke shop of operating an unlicensed business on tribal lands and then granted the defendant’s motion to dismiss, saying the court lacked subject matter over the action (Unkechaug Indian Nation v. Smokes For Less, No. 01574/2015, N.Y. Sup., Suffolk Co.; 2015 N.Y. Misc. LEXIS 1879).
