Judge: Tribe Can Recover Response Costs, Attorney Fees For Enforcement Actions

(July 7, 2016, 8:05 AM EDT) -- SPOKANE, Wash. — A federal judge in Washington on June 24 overruled a defendant company’s motion to reconsider an earlier ruling finding that the Confederated Tribes of the Colville Reservation can recover response costs for enforcement actions under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) after finding that he did not err in concluding that the tribe had the inherent authority to enforce the statute (Joseph A.
