Woman Says Wrongful Death Action Against Monsanto Not Preempted By Federal Law
Mealey's (July 1, 2016, 11:40 AM EDT) -- LOS ANGELES — A widow who is suing Monsanto Co. alleging that exposure to the company’s chemical glyphosate caused her husband to contract cancer and ultimately die filed a brief on June 24 in California federal court, contending that her complaint should not be dismissed because her failure-to-warn claims are not preempted and her design defect claim is not barred (Teri Michelle McCall v. Monsanto Company, No. 16-1609, C.D. Calif.).
