Patent Owner Asks High Court To Clarify Claim Construction Under Alice

(June 30, 2016, 11:56 AM EDT) -- WASHINGTON, D.C. — A patent owner on June 10 petitioned the U.S. Supreme Court to clarify the claim construction test under Alice Corp. Party Ltd. v. CLS Bank International (134 S. Ct. 2347 [2014]) because the Federal Circuit U.S. Court of Appeals is “hopelessly conflicted and confused” about how to apply it for deciding whether something is a patent-ineligible abstract idea (Jericho Systems Corp. v. Axiomatics, Inc. and Axiomatics AB, No. 15-1502, U.S. Sup.).
