Couple: Jury Should Decide If Misrepresentations Bar Coverage For Fire Loss

Mealey's (June 21, 2016, 4:21 PM EDT) -- ST. LOUIS — A couple told the Eighth Circuit U.S. Court of Appeals recently that a federal judge in Missouri erred in awarding summary judgment to Amica Mutual Insurance Co. for its refusal to pay benefits under a homeowners policy because a jury, not the court, should determine if the plaintiffs misrepresented the value of the home and their personal possessions and if they cooperated with the investigation into the claim (Dale Neidenbach, et al. v. Amica Mutual Insurance Company, No. 16-1400, 8th Cir.).
