Consumer’s Debt Collection Class Suit Survives Dismissal Motion

(June 15, 2016, 12:14 PM EDT) -- JACKSONVILLE, Fla. — A consumer may proceed with his class complaint against a debt collector and the company that the consumer claims was misidentified as the current creditor, a Florida federal judge ruled June 7 opining that she was unwilling, at such an early stage, to find the consumer’s claim against the debt collector lacked merit (David B. Ahr, et al. v. Convergent Healthcare Recoveries, Inc., et al., No. 15-1464, M.D. Fla.; 2016 U.S. Dist. LEXIS 74001).
