Certiorari Denied In Seminole Tribe’s Battle Over Florida Utility Tax

Mealey's (June 13, 2016, 10:13 AM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court on June 13 declined to review an 11th Circuit U.S. Court of Appeals ruling that Florida’s utility tax is directed at utility providers and not an Indian tribe, which challenged the tax in federal court, arguing that allowing a utility provider to pass on a utility tax to a federally recognized Indian tribe for utility services amounts to an impermissible direct tax on the tribe (Seminole Tribe of Florida v. Leon Biegalski, No. 15-1064, U.S. Sup.).
