Arbitrary And Capricious Standard Of Review Applies, Kentucky Federal Judge Says
(June 9, 2016, 10:14 AM EDT) -- LONDON, Ky. — An arbitrary and capricious standard of review will be applied in a disability benefits suit, a Kentucky federal judge said June 1 after determining that Texas law does not invalidate the plan’s grant of discretionary authority to the insurer (Alan Littleton v. Liberty Life Assurance Company of Boston d/b/a Liberty Mutual, No. 15-187, E.D. Ky.; 2016 U.S. Dist. LEXIS 71154).
