Appeals Court Affirms Ruling That Builder’s Third-Party Claims Are Perempted

(June 7, 2016, 2:33 PM EDT) -- BATON ROUGE, La. — A Louisiana appeals panel on June 3 ruled that a trial court judge did not err when refusing to retroactively apply amendments made in 2012 to Louisiana Revised Statute 9:2772 when finding that a home builder’s third-party claims against a subcontractor and its insurer were perempted (Adrian Kelleher, et al. v. Custom Homes by Jim Fussell Inc., et al., No. 2015 CA 1798, La. App., 1st Cir.; 2016 La. App. Unpub. LEXIS 219).
