California Federal Judge Denies Remand, Tosses Negligence Suit

(June 6, 2016, 12:31 PM EDT) -- LOS ANGELES — A California federal judge on May 31 denied a plaintiff’s motion to remand a medical negligence case to state court and granted the defendant’s motion to dismiss the case (Janet Sikiyan v. Gabrielle Morris, M.D., et al., No. CV16-1699, C.D. Calif.; 2016 U.S. Dist. LEXIS 71618).

U.S. Judge Philip S. Gutierrez of the Central District of California ruled that Janet Sikiyan’s state law claim for medical negligence is completely preempted by the Employee Retirement Income Security Act.
