Flint, Mich., Says It Is Immune From Lawsuit For Lead Contamination

Mealey's (June 6, 2016, 9:20 AM EDT) -- DETROIT — The City of Flint, Mich., which is one of the defendants in a lawsuit filed by residents who contend that they have been injured as a result of lead-contaminated drinking water, on May 26 filed a brief in Michigan federal court arguing that the claim for violation of civil rights under 42 U.S. Code Section 1983 is preempted by federal law and the city is entitled to sovereign immunity as an “arm of the state.” The city also argues that the State of Michigan and Michigan Gov. Rick Snyder lack standing to oppose the city’s sovereign-immunity defense (Melissa Mays, et al. v. Gov. Rick Snyder, et al., No. 15-14002, E.D. Mich.)....
