Florida Appellate Panel Enforces Check Cashing Company’s Class Action Waiver

(June 2, 2016, 10:09 AM EDT) -- WEST PALM BEACH, Fla. — A trial court erred when it referred the enforceability of a class action waiver in contracts between a check cashing company and its customers to an arbitrator as the Florida high court also found class arbitration was expressly prohibited, a Fourth District Florida Court of Appeal panel ruled May 18 (McKenzie Check Advance of Florida, LLC d/b/a National Cash Advance, et al. v. Wendy Betts, et al., No. 4D15-1893, Fla. App., 4th Dist.; 2016 Fla. App. LEXIS 7662).
