Judge Denies Building Owner’s Request For Summary Judgment Over Leaky Windows

Mealey's (May 31, 2016, 1:14 PM EDT) -- NEW ORLEANS — A federal judge in Louisiana on May 27 denied a building owner’s motion for partial summary judgment on its claim for breach of the warranty against redhibitory defects against the manufacturer of windows that allegedly leaked after installation, holding that genuine issues of material fact exist as to whether improper installation caused the leaks rather than a defect in the windows (425 Notre Dame LLC v.
