Texas Supreme Court: Accommodation Doctrine Applies To Groundwater

(May 31, 2016, 9:45 AM EDT) -- AUSTIN, Texas — The Texas Supreme Court ruled May 27 that the state’s accommodation doctrine applies to owners of groundwater rights (Coyote Lake Ranch, LLC v. The City of Lubbock, No. 14-0572, Texas Sup.; 2016 Tex. LEXIS 415).

The City of Lubbock owns groundwater under Coyote Lake Ranch, a 26,000-acre agriculture and cattle ranch. In 1953, it sold its groundwater to the City of Lubbock, and to date, the city has drilled seven water wells.
