Court Calls For Recalculation Of Mineral Rights Damages Award In Fracking Case

Mealey's (June 18, 2015, 3:27 PM EDT) -- HARRISBURG, Pa. — The Pennsylvania Superior Court on Oct. 20, 2014, partially affirmed and partially vacated a trial court’s ruling in an oil, gas and mineral rights dispute and remanded the case to the trial court for a recalculation of damages that were awarded for a mineral rights owner’s compensation from an energy company that failed to pay him royalties for the oil and gas produced from his land using the hydraulic-fracturing method referred to as horizontal drilling (Dennis Sabella v. Appalachian Development Corporation, et al., No. 2014-237, Pa. Super.)....
