Court Remands Appeal Involving Bare-Metal Defense, Asbestos Negligence Claims

(May 24, 2016, 12:15 PM EDT) -- PHILADELPHIA — Remand is necessary so that the judge overseeing the federal asbestos multidistrict litigation can address the bare-metal defense’s application to a couple’s negligence claim, the Third Circuit U.S. Court of Appeals held May 12 in remanding a case (Kenneth McAfee and Shirley McAfee v. Ingersoll Rand & Co., No. 15-2667, 3rd Cir.).
