Panel: Clause ‘Ambiguous’; Royalty Interest Dispute Sent Back To Trial Court

(May 23, 2016, 3:14 PM EDT) -- CORPUS CHRISTI, Texas — A Texas appeals court on May 19 said fact issues exist in a case regarding hydraulic fracturing royalty interests because the deed in question is “ambiguous”; therefore, the trial court erred in entering a declaration on summary judgment in favor of the parties that purchased the royalty interest from the original owner (ConocoPhillips Company, et al. v. Ralph Wade Koopmann, et al., No. 13-14-00402, Texas App., 13th Dist., Corpus Christi-Edinburg; 2016 Tex. App. LEXIS 5278).
