Split Florida High Court: Fracking-Related Electricity Rate Increase Improper

(May 23, 2016, 1:51 PM EDT) -- TALLAHASSEE, Fla. — A divided Florida Supreme Court on May 19 ruled that the Florida Public Service Commission (PSC) lacked the authority to allow a state utility to recover the capital investment and operations costs of its partnership in a hydraulic fracturing operation through rates charged to the utility’s customers (Citizens of the State of Florida v. Art Graham, et al., Nos. SC15-95, SC15-113, and SC15-115 and Florida Industrial Power Users Group v. Art Graham, et al., No. SC15-274, Fla. Sup.).
