9th Circuit: Deceptive Labeling Class Complaint Should Be Dismissed With Prejudice

(May 18, 2016, 2:47 PM EDT) -- SEATTLE — A district court properly dismissed a class complaint accusing the maker and retailer of a caffeinated beverage of false labeling claims; however, the complaint should have been dismissed with prejudice, the Ninth Circuit U.S. Court of Appeals ruled May 9 (Harold Maple, et al. v. Costco Wholesale Corporation, et al., Nos. 13-36089 and 14-35038, 9th Cir.; 2016 U.S. App. LEXIS 8524).
