(May 18, 2016, 2:45 PM EDT) -- SEATTLE — A Ninth Circuit U.S. Court of Appeals panel on May 5 affirmed a trial court’s decision to remand pursuant to the Class Action Fairness Act’s (CAFA) local controversy exception a class suit accusing The Boeing Co. of polluting groundwater around one of its facilities and Landau Associates of negligent investigation and remediation (Jocelyn Allen, et al. v. Boeing Company, et al., No. 16-35175, 9th Cir.; 2016 U.S. App. LEXIS 8324).
