Federal Judge: Insurers Have No Duty To Defend Indemnify Charity Organization
Mealey's (May 18, 2016, 10:00 AM EDT) -- LOUISVILLE, Ky. — A Kentucky federal judge on May 4 held that two primary insurers and one excess insurer have no duty to defend or indemnify their charity organization insured against counterclaims in a dispute arising from funding for a pediatric hospital because the counterclaims do not seek damages for personal and advertising injury (National Fire Insurance Company of Hartford, et al. v. Kosair Charities Committee, Inc., et al., No. 15-00577, W.D. Ky.; 2016 U.S. Dist. LEXIS 59614).
