Railroad, Lung Cancer Sufferer Spar Over Extent Of 1995 FELA Release

(May 16, 2016, 9:21 AM EDT) -- PHILADELPHIA — A railroad on May 6 urged a federal judge in Pennsylvania to reject reconsideration of his ruling that an asbestos-related nonmalignant disease settlement in 1995 barred a man’s subsequent lung cancer claim under the Federal Employers’ Liability Act (FELA) (James S. Collier, et al. v. CSX Transportation Inc., No. MDL 875, 15-6823, E.D. Pa.).
