Federal Judge Rejects Mother’s Gender Reassignment ACA Discrimination Suit

Mealey's (May 13, 2016, 1:14 PM EDT) -- MINNEAPOLIS — A mother has not shown that the company she sued for allegedly violating Patient Protection and Affordable Care Act (ACA) rules against discrimination administered her health plan or that an administrator could do anything about allegedly discriminatory plan exclusions on gender reassignment surgery, a federal judge in Minnesota held May 11 (Brittany R. Tovar v. Essentia Health, Innovis Health LLC d/b/a Essentia Health West and HealthPartners Inc., No. 16-100, D. Minn.; 2016 U.S. Dist. LEXIS 62529).
