Amicus Curiae Filers Support Review Ruling On Foreign Sales’ Impact On Patents

Mealey's (May 12, 2016, 3:21 PM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court should review the Federal Circuit U.S. Court of Appeals’ ruling that foreign sales do not exhaust a patent owner’s right to sue and that patent owners can impose restrictions on the use of patented items to prevent an exhaustion of their rights to the intellectual property, amicus curiae filers argue on behalf of Impression Products Inc. in separate briefs filed April 21 (Impression Products Inc. v. Lexmark International Inc., No. 15-1189, U.S. Sup.).
